How to Protect Your Brand: Step-by-Step Trademark Registration Process in India

Protecting Your Intellectual Property: The Indian Trademark Guide #

Your brand name, logo, slogan, and packaging are among the most valuable assets your company will ever own. Registering a trademark under the Trade Marks Act, 1999 grants you exclusive legal ownership and the constitutional right to sue for infringement and passing off.

1. Step-by-Step Trademark Registration Workflow #

Step 1: Trademark Search & Class Selection #

India follows the international NICE classification, comprising 45 distinct classes (Classes 1 to 34 for goods, Classes 35 to 45 for services).

  • Example: Class 35 covers retail and business consultancy, Class 42 covers software and IT services, and Class 25 covers clothing.
  • A thorough public search on the IP India portal is mandatory to confirm that no identical or phonetically similar mark exists.

Step 2: Filing Form TM-A #

Once availability is verified, the application is submitted electronically on the IP India portal.

  • Government Fee: ₹4,500 for Individuals/Startups/MSMEs with Udyam certificate; ₹9,000 for standard enterprises.
  • Immediately upon filing, you earn the right to use the ™ symbol next to your brand name!

Step 3: Examination by the Trademark Registry #

Within 1 to 3 months, an examiner reviews the application under Section 9 (absolute grounds of refusal, e.g., descriptive or generic terms) and Section 11 (relative grounds, e.g., resemblance to an existing mark).

  • If clear, the mark is accepted and advertised in the Trademark Journal.
  • If an Examination Report with objections is issued, a formal legal response must be submitted within 30 days.

Step 4: Publication in the Trademark Journal #

The mark is published in the weekly Trade Marks Journal for a 4-month opposition window, allowing third parties to contest the registration.

Step 5: Registration Certificate #

If no opposition is filed (or if an opposition is decided in your favor), the Registrar issues the Certificate of Registration. You can now proudly affix the ® symbol!

2. Trademark Validity & Renewal #

A registered trademark remains valid for 10 years from the filing date and can be renewed indefinitely every 10 years by filing Form TM-R.
